By placing your order you indicate that you agree with the delivery and payment conditions. Pure4sports has the right to change its delivery and/or payment conditions after the expiry of the term. If you receive items that you have not ordered, you must notify Pure4sports. Any inaccuracies in the information provided to you by Pure-Training must be reported to Pure-Training immediately.

Article 1. General
1.A) Pure4sports was started in 2021 and is an extension of existing websites of the parent company I-Shopz B.V.

Article 2. Applicability
2.A) These General Terms and Conditions of Sale (hereinafter: Conditions) apply to all offers, orders and agreements concluded using the Pure4sports website.

2.B) Accepting an offer or placing an order is subject to acceptance of the applicability of these Terms and Conditions.

2.C) The stipulations in these Terms and Conditions can only be deviated from in writing. If any part of these General Terms and Conditions is deviated from, the other provisions will remain in full force and effect.

2.D) All rights and claims, as stipulated in these Terms and Conditions and in any further agreements for the benefit of Pure4sports, are also stipulated for the benefit of intermediaries and other third parties engaged by Pure4sports.

2.E) If any of the articles of these Terms is declared invalid by a court order or by a binding decision of another competent authority, the other provisions of these Terms will remain in effect.

Article 3. Agreements
3.A) An agreement is concluded after acceptance of a customer's order by Pure4sports is entitled to refuse orders or to request additional information. If an order is not accepted, this will be communicated to the customer, stating the reason.

3.B) Some of the products can be offered with an age rating. By ordering these products, you declare that you are at least of the age required to purchase the product.

Article 4. Prices
4.A) The prices stated for the articles are in euros, including VAT and legal disposal fee, unless stated otherwise. Shipping costs are (unless stated otherwise) not included in the stated prices.

4.B) In some cases there are promotional prices. Promotional prices are only valid for a certain period while stocks last. These prices can no longer be claimed before or after the specified period.

4.C) Pure4sports  cannot be held to price statements that are clearly incorrect, for example as a result of obvious typesetting or printing errors. No rights can be derived from unlawful price information.

Article 5. Payments
5.A) Payment can be made in (one of) the way(s) as indicated during the ordering process.

5.B) The customer gives Pure4sports permission to perform all actions that are necessary for payment to take place in the payment method chosen by the customer.

Article 6. Delivery
6.A) Pure4sports  strives to deliver orders within 24 hours of receipt of payment. However, Pure4sports is not obliged to do this.

6.B) The latest delivery time is 30 days after placing the order, except insofar as the delay cannot be attributed to Pure4sports.

6.C) If the delivery is either (temporarily) out of stock, or is delayed for other reasons, or if an order cannot or only partially be executed, the customer will receive this no later than thirty (30) days after receiving the order. order placed has message. In that case, the customer has the right to cancel the order without penalty. Pure4sports will in that case arrange for a refund.

6.D) If delivery of an ordered item proves to be impossible, Pure4sports will make such efforts as is reasonable and fair to make a replacement item available. At the latest upon delivery, it will be stated in a clear and comprehensible manner that a replacement item will be delivered. The costs of return shipment are for the account of Pure4sports when a replacement item is made available.

6.E) Deviations in colour, type, text and/or price changes reserved.

6 F) If you are not at home on the agreed date, we reserve the right to pass on the transport costs incurred to you. During transport, your items are insured against loss and damage for complete safety. By default, all articles are offered twice and then arrive at a pick-up location issued by the relevant carrier. We send all packages via 

DHL and letter post via TNT.

6.G) Delivery only takes place when payment of your order has been received or if you indicate with your order that you want to receive it cash on delivery, then you pay the DHL courier.

Article 7. Retention of title
Ownership of the delivered products only transfers if the customer has paid all that the customer owes Pure4sports on the basis of the agreement(s) concluded with regard to the delivered products.

Article 8. Intellectual and industrial property rights
8.A) The customer must fully and unconditionally respect all intellectual and industrial property rights that rest on the products supplied by Pure4sports.

8.B) Pure4sports does not guarantee that the products delivered to the customer do not infringe any (unwritten) intellectual and/or industrial property rights of third parties.

8.C) The Buyer expressly acknowledges that all intellectual property rights of displayed information, communications or other expressions with regard to the products and/or with regard to the internet site are vested in Pure4sports, its suppliers or other entitled parties.

8.D) The Buyer is prohibited from making use, including making changes, of the intellectual property rights as described in this article, such as reproduction, without the express prior written permission of Pure4sports, its suppliers or other entitled parties, unless it is solely concerns private use in relation to the product itself.

Article 9. Conformity
Pure4sports guarantees that the goods and/or services meet the specifications stated in the offer, the reasonable requirements of reliability and/or usability and that they do not conflict with the legal provisions existing on the date of the conclusion of the agreement and / or government regulations.

Article 10. Not good money back
10.A) You have the obligation to examine whether the products comply with the agreement upon delivery.

10.B) In the context of this Money Back Guarantee, the customer may return the product to Pure4sports within 14 days after delivery in the manner indicated at delivery. When returning, the product must be packed in its original packaging, complete, undamaged and unused.

10.C) If the customer makes use of the Money Back Guarantee, Pure4sports will refund the amount already paid to the customer within thirty days. Good money back only applies if the goods do not meet the expected requirements. You can also read all this in article 6 delivery.

10.D) If the product cannot be returned due to its nature;

is clearly personal in nature; can spoil or age quickly; and/or, video recordings or computer software.
There is a reflection period within the framework of the Money Back Guarantee only if the customer has not yet broken the seal of the packaging or, in the absence of a seal, has not yet opened the packaging.

Unstamped returns are not accepted.

10.E) The customer must always first provide the seller with the reason for the return. This can be sent to info@i-shopz.nl. After approval, the return will only be accepted. The shipping costs are not reimbursed.

Article 11. Orders / communication
For misunderstanding, mutilations, delays or improper transmission of orders and communications as a result of the use of the Internet or any other means of communication in the traffic between the customer and Pure4sports, or between Pure4sportsand third parties, insofar as it relates to the relationship between the customer and Pure4sports, Pure4sports is not liable, unless and insofar as there is intent or gross negligence on the part of Pure4sports.

Article 12. Force majeure
In the event of force majeure, Pure4sports has the right, at its own discretion, to suspend the execution of a customer's order, or to dissolve the agreement without judicial intervention, by notifying the customer in writing and without Pure4sports.com is obliged to pay any compensation, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness.

Article 13. Applicable law and competent court
13.A) All rights, obligations, offers, orders and agreements to which these Conditions apply, including these Conditions, are exclusively governed by Dutch law.

13.B) All disputes between the parties will be submitted exclusively to the competent court in the Netherlands in Amsterdam.

Article 14. Questions, complaints and comments about this Thuiswinkel
14.A) In the event of a dispute, the customer must notify Pure4sports of this within a reasonable period of time. This can be done via info@i-shopz.nl. Pure4sports will handle the complaint within 30 days of receipt.

15.A) Billink conditions

If you choose to pay afterwards, you must pay the amount to Billink B.V. within the set payment term. (hereinafter: “Billink”). After all, all rights under the claim have been transferred by us to Billink, who will take care of the collection of the claim. Your data will be tested and registered by or on behalf of Billink. This data can be used, among other things, for the collection of outstanding claims, marketing purposes, data verification and the testing of orders in the implementation of the acceptance policy of organizations and/or clients affiliated with Billink. Billink reserves the right to refuse the customer's request for payment on account. The Version used: 9 July 2018 payment term is a strict deadline. In the event of late payment, the customer is therefore in default without notice of default and Billink is entitled to charge statutory commercial interest monthly from the due date of the invoice (whereby part of a month is regarded as a whole month). Billink is also entitled to charge extrajudicial collection costs to the customer on the basis of the law. In the case of business customers, Billink is also entitled to charge reminder and reminder costs to the customer, without prejudice to Billink's right to charge the customer for the costs actually incurred if they exceed the amount calculated in this way. These costs amount to a minimum of 15% of the principal with a minimum of 40 euros for consumers and 75 euros for businesses. Billink is also entitled to transfer the claim to a third party. What has been determined in the foregoing with regard to Billink will in that case also be transferred to the third party to whom the claim has been transferred.

For Belgian customers: Non-payment of the invoice on the due date leads to the start of internal and external reminder procedures. By operation of law and without notice of default, a fixed administrative cost of € 12.50 will be charged per internal reminder sent by Billink. As soon as Billink is obliged to transfer the claim to a specialized collection agency, this due to permanent non-payment, the claim is also increased by a fixed compensation clause, on account of non-payment, of 20% with a minimum of € 10 as well as late payment interest at the rate of 12 % per year, calculated on the amount of the invoice from the date of dispatch of the invoice. The costs associated with this transfer of file as well as the compensation for the collection of the amounts due are estimated at a fixed amount at € 35.00 and remain fully at your expense, without prejudice to the costs described above for internal reminders, fixed compensation clause and late interest. The courts of the judicial district of Antwerp have sole jurisdiction to settle disputes concerning the payment or the execution of our deliveries.
